“Nagbayad na ako sa property… pero nasaan ang titulo at ownership documents?”

The recent news involving an alleged illegal land sale in Cebu should serve as an important reminder to every property buyer, seller, agent, and broker:

Never allow excitement, trust, or promises to replace proper REAL ESTATE DUE DILIGENCE.

According to the news report, a buyer allegedly paid ₱1.6 million for two parcels of land but reportedly failed to receive the necessary ownership documents. Authorities also alleged that the real estate firm involved had no valid License to Sell and was not registered as a real estate developer or dealer.

The case is still subject to proper investigation and legal proceedings, but it gives us an important real estate lesson.

❓ BEFORE YOU PAY FOR A PROPERTY, WHAT SHOULD YOU CHECK?

Due diligence is not simply asking:

“May titulo ba?”

A proper property transaction may require verification of several important matters:

✔️ Is the person selling the property the true registered owner or properly authorized representative?

✔️ Is the Transfer Certificate of Title or Original Certificate of Title genuine and updated?

✔️ Are there mortgages, liens, adverse claims, notices of lis pendens, or other annotations?

✔️ Are there estate or inheritance issues involving deceased owners and heirs?

✔️ Does the actual property location, boundaries, and land area match the title and technical description?

✔️ Is there a legal and physical Right of Way?

✔️ Are the Real Property Taxes updated?

✔️ Is the person marketing or facilitating the transaction properly licensed or authorized when required by law?

✔️ If the property is part of a subdivision, condominium, or development project, are the necessary government registrations, permits, and License to Sell requirements complied with, when applicable?

✔️ Most importantly: What exactly are you paying for, who will receive the money, and what legal documents will protect your payment?

⚠️ PAYMENT IS NOT THE SAME AS OWNERSHIP

This is one of the most important lessons every buyer must understand.

Paying money for a property does not automatically guarantee that ownership has been legally transferred to you.

A buyer should understand the complete transaction process—from document verification, contract review, payment terms, execution of the proper deed, tax compliance, issuance of the CAR/eCAR when applicable, transfer registration, up to the issuance of the new title.

🛑 “TRUSTED MAN NAMO ANG SELLER.”

Trust is important.

But trust is not a substitute for verification.

Even transactions involving relatives, friends, referrals, or long-time acquaintances can encounter problems because of incomplete documents, unsettled estates, unauthorized sellers, title defects, boundary disputes, or misunderstanding of the transaction.

Due diligence protects not only the buyer. It also protects legitimate sellers, brokers, agents, and property owners.

💡 THE BIGGEST REAL ESTATE MISTAKE?

Many buyers conduct due diligence AFTER they have already paid.

The safer approach is:

VERIFY FIRST. UNDERSTAND THE RISKS. DOCUMENT THE AGREEMENT. THEN DECIDE BEFORE RELEASING SUBSTANTIAL PAYMENT.

A property can look like a good investment.

The price can look attractive.

The seller can appear trustworthy.

But before you invest your hard-earned money, make sure you also invest in proper verification.
