SC: Condominium Corporations Do Not Engage in Trade or Business by Merely Collecting Association Dues

The Supreme Court of the Philippines has clarified an important issue concerning condominium corporations and the taxation of association dues.

The Court ruled that condominium corporations are not considered engaged in trade or business merely because they collect association dues, membership fees, and similar assessments from unit owners.

According to the ruling, these collections are intended to fund the maintenance, preservation, repair, and administration of the condominium's common areas and facilities.

Because the assessments are collected for the benefit and upkeep of the condominium community, rather than as payment for the sale of goods or services, they do not constitute taxable income in the manner contemplated by the questioned tax regulations.

The Supreme Court declared BIR Revenue Memorandum Circular (RMC) No. 65-2012 invalid insofar as it subjected association dues and similar assessments collected by condominium corporations to income tax, value-added tax (VAT), and withholding tax on the basis that these corporations were engaged in trade or business.
